Terms of Service

These terms are the agreement between you and My Fish Spots ("My Fish Spots," "we," "us") for using the My Fish Spots app and website (together, "the service"). You accept them when you create an account, and again when you accept an updated version in the app. If you don't agree, please don't use the service.

How we handle your personal information is covered separately in our Privacy Policy, which forms part of these terms.

1. Who can use My Fish Spots

  • You must be at least 18 years old.
  • You need a phone number that can receive an SMS verification code. One account per person; don't create an account for someone else or pretend to be someone you are not.
  • Keep your sign-in details to yourself. You are responsible for what happens on your account.
  • You can't use the service if we have blocked your account, or if you are barred from using it under the laws that apply to you.

2. What My Fish Spots is — and is not

My Fish Spots is a community app for sharing fishing activity: reports, trips, messages and a leaderboard. Please read this section carefully.

  • Not an official reporting or compliance tool. You remain solely responsible for following all fishing laws and regulations — permits, quotas, size and season limits, closed areas, and any mandatory federal or state reporting. Nothing you record in My Fish Spots satisfies a legal reporting obligation.
  • Not for navigation. The charts in the app are not for navigation. Always use proper, up-to-date nautical charts and navigation equipment.
  • Not a safety tool. Weather, sea, tide, water temperature and depth figures come from third-party sources and may be wrong, delayed or missing. Trip recording and location sharing can stop or lag without warning, and must never be relied on to know where a vessel is or to call for help. In an emergency, use your radio and contact the Coast Guard.
  • Reports come from other users. We don't check that reports are accurate, and you use them at your own risk.
  • Your records are records. Reports and trip tracks are timestamped records of where and when you fished. Think about who you share them with.

3. Your content

"Your content" means what you put into the service: reports, photos, captions, comments, messages, trip tracks, locations and profile details.

  • You own your content. We don't claim ownership of it.
  • You give us permission to use it to run the service. You grant My Fish Spots a worldwide, non-exclusive, royalty-free licence to store, copy, process, display and transmit your content, only as needed to operate, secure and improve the service — for example, showing a report to the audience you chose, delivering a message, checking a catch photo, or reviewing flagged content. This licence ends when your content is deleted, except for copies we must keep as described in the Privacy Policy.
  • You choose the audience. Who can see a report or trip depends on the sharing choices you make. Anyone who can see a report can see its exact location on the map. Once someone has seen your content, we can't make them forget it.
  • You are responsible for your content. Only post content you have the right to share. Don't share other people's personal information, or their location or catch details, without their permission — including a crewmate's.

4. Community rules

We have zero tolerance for objectionable content and abusive users. When using My Fish Spots, you must not:

  • Post anything illegal, including content that sexualises minors, promotes illegal fishing or other illegal activity, or infringes someone else's rights.
  • Threaten, harass, bully, intimidate or stalk anyone, or post hateful content.
  • Post anything shared with everyone that falls below a PG-13 standard, including sexually explicit or gratuitously violent material.
  • Deliberately post false or misleading reports, fake catches or re-used catch photos, or try to game the leaderboard.
  • Impersonate another person, boat or organisation, including My Fish Spots or its official accounts.
  • Send spam or unwanted commercial messages, or use the contact-invite feature to email people you don't know.
  • Try to see content, locations or tracks that weren't shared with you, or get around a block, a sharing setting or any other restriction.
  • Scrape, harvest or bulk-download data from the service, or use automated tools to access it.
  • Interfere with, disrupt, probe or reverse-engineer the service, or upload malicious code.

5. Reporting problems, moderation and enforcement

  • You can flag any report or message that breaks these rules, and block users from messaging you or sending you friend requests.
  • Flags are reviewed by a person. Photos on catch reports are also checked automatically to keep the leaderboard honest; anything that fails that check goes to a person as well, and is never penalised automatically.
  • If we decide content breaks these terms, we may remove it, remove leaderboard points it earned, warn you, or block your account — temporarily or permanently. For serious breaches we may act without warning.
  • Where content appears to be illegal, we may preserve it and report it to the appropriate authorities.

6. Boats, groups and crew

If you create a boat or group, you manage who belongs to it. Members can see content shared with that boat or group, and a boat's crew can see trips recorded on that boat unless the person recording turns that off. If you delete your account while you own a boat or group, it passes to another member as described in the Privacy Policy.

7. The leaderboard

Leaderboard points are for fun and bragging rights. They have no cash value, can't be transferred, and may be adjusted or removed — for example, when a catch fails verification or content is removed.

8. Other services

The service relies on third parties, such as data providers for weather, marine and tide information and the app stores you downloaded My Fish Spots from. We aren't responsible for their services, and your use of them may be subject to their own terms.

9. Ending your use of My Fish Spots

You can stop using the service and delete your account at any time — in the app (You → Profile → Delete account) or at myfishspots.com/delete-account. We may suspend or end your access if you break these terms, if we're required to by law, or if we stop offering the service. If we shut the service down, we'll try to give you reasonable notice and a way to get a copy of your own data first. Sections 2, 3 (for content we're allowed to keep), 10, 11, 12 and 14 continue after your account ends.

10. No warranties

The service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied — including that the service will be accurate, reliable, uninterrupted, secure or error-free, or fit for any particular purpose, and including any warranty about reports, charts, conditions data, trip tracks or locations.

11. Limits on our liability

To the fullest extent the law allows, My Fish Spots will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost catch, lost earnings, fines or penalties, damage to vessels or equipment, personal injury, or loss of data, arising from or related to your use of the service — including reliance on any report, chart, conditions data, trip track or location shown in it. Our total liability for any claim relating to the service is limited to one hundred US dollars (US$100).

Some places don't allow some of these exclusions or limits, so they may not all apply to you. Nothing in these terms limits liability that can't legally be limited.

12. Your responsibility to us

If someone brings a claim against My Fish Spots because of your content, your breach of these terms, or your breach of any law or regulation (including fishing regulations), you agree to cover our reasonable losses and costs arising from that claim, to the extent the law allows.

13. Changes to these terms

We may update these terms as the service changes. If a change is material, we'll update the date above and ask you to accept the new terms in the app before you continue using it. If you don't accept, you can delete your account.

14. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Massachusetts, unless the law where you live gives you the right to bring it elsewhere.

15. Apple and Google

If you downloaded My Fish Spots from Apple's App Store or Google Play: these terms are between you and My Fish Spots only, not Apple or Google, and My Fish Spots — not Apple or Google — is responsible for the app, its content, maintenance, support, and any claims relating to it (including product liability, legal or regulatory compliance, and intellectual-property claims). Apple and Google have no obligation to provide maintenance or support for the app. If the app fails to meet an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation for the app. You must comply with the app store's own terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

16. General

If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term straight away, we haven't given up the right to do so later. You can't transfer your rights under these terms; we may transfer ours to someone who takes over the service. These terms and the Privacy Policy are the whole agreement between you and us about the service.
